Nintendo Fans Take Action: Lawsuit Over Tariff Refunds

Nintendo enthusiasts are making their voices heard as they file a class-action lawsuit demanding that the company return tariff refunds to customers. These refunds are a result of higher prices that fans have been paying for Switch 2 accessories and the original Switch consoles throughout the past year.

The legal move aims to ensure that Nintendo doesn’t keep the extra cash from these refunds, especially since fans have already been shelling out more money due to inflated prices. Recently, Nintendo had taken a swing at the U.S. government, challenging what it called “unlawful” tariffs, but that legal battle has been temporarily paused as both sides sort through the chaos.

As it stands, Nintendo, alongside many other companies, is expected to benefit from a massive $160 billion in tariff refunds owed to businesses after a ruling from the U.S. Supreme Court. This situation has prompted two dedicated fans, Gregory Hoffert and Prashant Sharan, to step up and file this class-action lawsuit, directly tying Nintendo’s price hikes to the U.S. tariffs.

The lawsuit even brings to light previous comments made by Nintendo’s president, Shuntaro Furukawa, who noted last year that these tariffs would impact product costs, leading to higher prices for consumers. While Nintendo hasn’t changed the price of the Switch 2 consoles, they did raise the prices of various peripherals right after the tariffs were imposed. To add to the surprise, last summer, they also increased the price of their aging Switch 1 console—a move that seemed unthinkable not too long ago.

Additionally, earlier this year, Nintendo announced it would no longer keep the same price for digital and physical versions of games, acknowledging that boxed copies incur higher manufacturing and shipping costs.

Nintendo isn’t alone in facing such legal challenges; other companies have also experienced similar lawsuits from customers who are eager to recover the extra money they paid due to tariff-induced price increases. In an interesting twist, FedEx recently announced they would return some of their tariff refunds directly to consumers. As for Nintendo, they have yet to respond to inquiries regarding this ongoing situation.
